A jury found Daniel Joseph Forster guilty of one count of driving under the influence of alcohol in violation of Vehicle Code section 23152, subdivision (a), one count of driving while having a blood alcohol concentration of .08 percent or more in violation of section 23152, subdivision (b), and one count of driving with a suspended license in violation of section 14601.2, subdivision (a). In connection with allegations under counts 1 and 2 that Forsters blood alcohol content was .20 percent or more ( § 23206.1), the jury was unable to make findings, and the trial court dismissed those allegations. Following the jury verdicts, Forster admitted allegations that within seven years of the commission of the charged offenses he had suffered three prior convictions of driving under the influence within the meaning of section 23175, thus elevating counts 1 and 2 to felonies.
